H-1B FY2027: What Sacramento Employers and Applicants Need to Know Right Now

The H-1B FY2027 petition filing window is open. USCIS completed its initial selection process on March 31, 2026, and selected beneficiaries can now file cap-subject petitions beginning April 1, 2026, with a deadline of approximately June 30, 2026. 3. Updated Form I-129 is Mandatory

USCIS requires the latest Form I-129 (edition 02/27/26) for all FY2027 filings. Using an outdated form means immediate rejection — not an RFE, not a delay. Always download the current version from uscis.gov before submitting.

 

Filing Tips: How to Prepare a Strong Petition

Getting selected is just the first step. USCIS still reviews every petition carefully. Here is what a strong FY2027 filing must include:

  • Approved Labor Condition Application (LCA) — file this first; it takes up to 7 business days
  • Detailed job description clearly establishing specialty occupation eligibility
  • Beneficiary’s educational credentials and transcripts
  • Employer support letter and organizational documents
  • Consistency across every document — any mismatch is a common RFE trigger
  • Consider Premium Processing if timing is critical, especially for F-1 OPT cap-gap situations

 

Filing deadline: You have 90 days from your selection notification date. Missing this deadline means losing your FY2027 H-1B opportunity with no appeal.
